General Terms and Conditions of Airportways Worldwide Ltd.
WHEREAS Airportways Worldwide Ltd. acts as an intermediate agent regarding the transfer or other type of transportation of persons (hereinafter referred to as the Transfer Service),
WHEREAS Airportways Worldwide Ltd., in order to satisfy the Client’s request of Transfer Service, cooperate with transportation companies (hereinafter referred to as the Transporter) all around the world, connecting the Client to the descent Transfer Service at the requested territory,
WHEREAS the other party as client (hereinafter referred to as the Client) orders the Transfer Service offered by Airportways Worldwide Ltd.,
WHEREAS the Client pays the fee of the Transfer Service (hereinafter referred to as the Transfer Fee) through the electronic card payment system (hereinafter referred to as the Transaction),
WHEREAS Airportways Worldwide Ltd. and the Client enters into a contract regarding the Transfer Service as per the conditions set forth and specified in this document of General Terms and Conditions (hereinafter referred to as the GTC).
WHEREAS Airportways Worldwide Ltd. organizes the Transfer Service according to the GTC, the corresponding local regulation, and the relevant international standards, also taking into account the special needs and requests of the Client in case those are communicated and agreed earlier by mutual consent of Airportways Worldwide Ltd. and the Client (together hereinafter referred to as the Parties),
WHEREAS the Parties act within the scope of their relationship in good faith and good intent, also by cooperating, and informing each other of all the relevant facts and events, which could affect the fulfilment and completion of the Transfer Service.
1. Shuttle Service
1.1. Shuttle Service, as a type of Transfer Service, is a low cost shuttle transfer. Bookings made by separate passengers who are willing to share a vehicle for their destination.
1.2. In case the Client orders and pays for a Shuttle Service, cancellation could not be accepted by Airportways Worldwide Ltd. on any ground or for any reason within 48 hours reckoned from the time the Shuttle Service is due and should be performed by Airportways Worldwide Ltd.. Accordingly, if the Client cancels the ordered Shuttle Service within 48 hours before the scheduled Shuttle Service, no refund shall be paid by Airportways Worldwide Ltd. to the Client. Therefore the Client shall not be entitled to void the Transaction, and/or Airportways Worldwide Ltd. is not obliged to transfer any amount to the Client’s bank account. The Client hereby agrees not to make any complaint regarding the cancellation within the period specified in this paragraph in order to get any remedy of either financial or any other type.
1.3. The Parties agree that the schedule of the Shuttle Service shall be followed strictly. Therefore, in case a Shuttle Service is booked, in order to avoid any delays regarding the schedule, the Transporter shall not wait at all for the Client, who is late from the Shuttle Service. However, in such cases the Transporter shall take the passenger on the next Shuttle Service to the same destination, on condition that a next Shuttle Service exists and the availability thereof allows.
1.4. The Shuttle Service shall leave as soon as possible after the arrival of all the passengers.
2. Private Transfer
2.1. Private Transfer is another type of Transfer Service, which is just like a taxi service. The Parties agree on the pick-up time and place, as well as the transfer fee and other special circumstances if required.
2.2. In case the Client is for any reason late from an ordered and booked Private Transfer, the Transfer Service waits 30 minutes from the scheduled arrival time. If this period elapses, the Client is considered to have missed the Transfer Service. However, if the Transporter is able to wait longer and has been requested to do so before the scheduled pick-up time by the client through calling the emergency number, the Transporter shall wait for the Client and the Client shall pay an additional sum as specified on the voucher. This additional sum is due and shall be paid by the Client before the departure of the transport vehicle.
2.3. The VIP type of the Private Transfer is exclusive since the driver wears a tie, suit, speaks English, and the transporting vehicle is a high-class limousine, as Mercedes S-class, BMW 7, Audi A8 or similar.
3. Cancellation, Extra requests Modification – General Clauses to be Applied for All Types of Transfer Services
3.1. All cancellations shall be made via e-mail or through the emergency number no later than 48 hours before the scheduled Transfer Service.
3.2. Extra requests (for additional transportation cost) may be only the following:
3.3.1. child seat installation in the transporting vehicle,
3.3.2. transporting bicycle/ski/snowboard and/or bigger objects as luggage in the transporting vehicle.
3.3. All extra requests shall be announced via e-mail no later than 48 hours before the scheduled time of the Transfer Service.
3.4. Any changes in the booking are available no later than 3 days before the day of the travel. Changes may result an additional cost on the top of the Transfer Fee. Low cost shared services and shuttle services are not changeable and non-refundable by any means.
4. Refund – General Clauses to be Applied for All Types of Transfer Services
4.1. Airportways Worldwide Ltd. may refund not more than 25% of the prepaid amount of the Transfer Fee, deducted with the Transaction costs.
4.2. No refund shall be paid or made available in case
4.2.1. the Client fails to provide Airportways Worldwide Ltd. with a contactable phone number, or
4.2.2. the Client misses to cancel the Transfer Service as per Section 3.1., or
4.2.3. the Client fails to answer the enquiring call of the Transporter, or
4.2.4. the Client does not provide Airportways Worldwide Ltd. with a valid address for the pick-up point of the Transfer Service, or
4.2.5. the flight is diverted and/or cancelled, or
4.2.6. the Client missed the scheduled pick-up time for any reason, or
4.2.7. the Client does not provide Airportways Worldwide Ltd. with all the requested data as per Section 5.7., or any relevant datum is provided incorrectly.
4.3. Airportways Worldwide Ltd. undertakes refund liability only for 75% of the amount of the Transfer Fee. The Client accepts this and hereby waives any and all further future claims (e.g. parking fee, taxi costs, etc.) exceeding the Transfer Fee.
5. Booking a Service
5.1. Payment is required at the time of the booking. Airportways Worldwide Ltd. has a secured payment system. When booking a Transfer Service through Airportways Worldwide Ltd.’s website, the Client can pay by credit card (VISACARD and MASTERCARD). The Client is obliged to provide valid card details and personal data for the operator.
5.2. It is the liability of the Client to provide a full and valid mobile phone number, including the international dialling code. If the Client does not have a valid mobile number, a home/office/hotel contact number has to be provided during the booking. If it is not possible to provide either of the above, it is the responsibility of the Client to contact the driver on the emergency number shown on the voucher. The Client is liable to check for messages left on your mobile phone or at any contact number provided for Airportways Worldwide Ltd. through the booking. Failure to contact the emergency number or to provide a contactable phone number may cause that the Client misses the Transfer Service. Under this circumstance no refund will be available.
5.3. Bookings via telephone can be made between 09:00 and 19:00 CET. If a booking is made by telephone the booking is subject to the GTC.
5.4. If two or more people are included on the same booking, the person purchasing the booking shall be deemed to be acting as an agent for both or all members of the party and accepts these booking conditions on behalf of each member of the party.
5.5. The Client will be taken to and collected from the drop-off and pick-up addresses stated on the voucher. It is the responsibility of the Client to provide a full and valid address for the transfer pick-up and/or drop-off point.
5.6. The Transfer Service is not booked until Airportways Worldwide Ltd. sends the voucher as official confirmation.
5.7. The Client shall provide Airportways Worldwide Ltd. with all pieces of information for all the bookings as requested through the related website and/or by the telephone operator. It is the liability of the Client to provide the information correctly. Airportways Worldwide Ltd. doers not take any responsibility for any damages or inconvenience deriving for any incorrect datum.
5.8. The printed confirmation voucher is the ticket and the invoice. Please print your voucher and show it to your driver.
6. Miscellaneous
6.1. Airportways Worldwide Ltd. acts solely as an agent in respect of all bookings. As such, Airportways Worldwide Ltd. does not itself provide airport transfers, city tours, sightseeing tours, event and congress transfers, multi-day coach tours and package tours.
6.2. The Client shall contact Airportways Worldwide Ltd. and/or the Transporter in cases specified above via e-mail and the emergency number. Both the referred e-mail address and the emergency number are indicated on the voucher of the Client.
6.3. All complaints shall be made in writing, via e-mail to the e-mail address specified on the voucher, within 72 hours reckoned from the questioned event. The letter of complaint must provide a proof of the undelivered service.
6.4. Airportways Worldwide Ltd. reserves the right to answer for complaints within 28 days.
6.5. Airportways Worldwide Ltd. refuses any financial claims deriving from the failed service of the Transporter.
6.6. By ticking the relevant box on the booking form on our website, the Client agrees on and accepts the GTC. Accordingly, the Client declares to have
6.6.1. read, understood, and accepted this GTC;
6.6.2. granted the consent thereof to our use the information provided as per Section 5.7., in accordance with the applicable legal provisions.
6.7. Airportways Worldwide Ltd., together with the Transporter, reserve the right to charge an excess baggage allowance or refuse to transport the items.
6.8. Airportways Worldwide Ltd. reserves the right (and delegates it to the Transporter) to refuse to carry any Client who is thought to be under the influence of alcohol or drugs and/or whose behaviour is considered to pose a threat to the driver, the vehicle or the other passengers.
6.9. The Client is not permitted to take alcoholic drinks onto airportways.com vehicles for the purpose of consuming them therein.
6.10. Smoking is not permitted in the transporting vehicles of Airportways Worldwide Ltd..
6.11. The transporting vehicles of Airportways Worldwide Ltd. are fully insured for passenger and third party claims, as required under local law. However, whilst every care is always taken, customers property is carried entirely at their own risk and no responsibility can be accepted for loss or damage. The Client is therefore advised to check his own travel insurance.
6.12. Airportways Worldwide Ltd. and the Transporter will endeavour to carry the Client with the minimum discomfort and inconvenience to the booked destination at the time shown on the voucher. However, Airportways Worldwide Ltd. will not incur any liability whatsoever, if circumstances beyond its control prevent the achievement of this responsibility. The following are examples of circumstances which are not within the control of Airportways Worldwide Ltd. (please note that the following list is not exhaustive):
• accidents causing delays to the vehicle;
• restricted vehicular access;
• exceptional or severe weather conditions;
• compliance with requests of the police;
• deaths and accidents on the road;
• vandalism and terrorism;
• unforeseen traffic delays;
• industrial action by third parties or strike;
• diverted flights to other airports;
• problems caused by other customers;
• the vehicle being held or delayed by a police officer or government official;
• other circumstances affecting passenger safety.
6.13. The Client is allowed to place two items of luggage in the vehicle. Any excess luggage must be declared at the time of booking. In the event of the Client having excess luggage, Airportways Worldwide Ltd. reserves the right to charge an excess baggage allowance or refuse to transport the items.
6.14. The Parties acknowledge that all bookings made by the Client are subject to this GTC.
